Terms of Service

This is the agreement between you and Elite Pilates Club. It covers booking a class, what happens when you cancel one, how credits and memberships work, what you pay and what we owe you in return. It is written to be read in one sitting.

Who this agreement is with

Elite Pilates Club (“the studio”, “we”, “us”) operates Pilates studios in the Philippines and the website at theelitepilatesclub.com. The registered business behind the trading name, its registration number and its registered office are set out on the legal index.

These terms apply whenever you use this website, hold an account with us, book a class, buy a package or membership, or train at either studio. If you do not accept them, do not book — reception will always take a question first.

Accepting these terms

You accept these terms when you create an account, book a class, or buy anything from us. You accept them electronically, and that is binding: under the Electronic Commerce Act of 2000 (Republic Act No. 8792) an electronic document and an electronic signature have the same legal effect as their paper equivalents. The record of what you accepted, and when, is held against your account.

Separately from these terms, before your first session you sign the studio’s Liability Waiver & Consent Form. Both documents apply; where the waiver is more specific about health and about conduct in the studio, the waiver governs that subject.

Who can book, and minors

You must be 18 or over to hold an account and to agree to these terms yourself. Anyone under 18 may still train with us, but a parent or legal guardian has to give consent, be named on the account with a contact number, and accepts these terms and the waiver on the young person’s behalf.

We may ask for proof of age or of guardianship at any point, and we may decline a booking until we have it.

Your account

An account is personal to you. It holds your bookings, your credit balance and its expiry dates, your membership, your payment history and receipts, your health answers and your marketing preferences.

  • Keep your details accurate — we send booking and payment confirmations to the email on the account.
  • Keep your password to yourself. Anything done through your account is treated as done by you.
  • Do not share, sell or transfer your account, your credits or your membership to anyone else.
  • Tell us at once if you think someone else has got into your account.

You can change your details, your health answers and your marketing preference yourself at any time under My account → Profile.

Booking a class

Sessions are booked in advance, through your account or at reception. A place is yours only once the booking is confirmed — a class shown as available is not held for you while you decide.

  • The cut-off. Online booking closes a set number of minutes before a class starts. The exact cut-off is a studio setting and is shown to you on the session before you confirm; after it passes, ask reception.
  • How many a day. The studio sets a limit on how many classes one member may hold on the same day. If you are at the limit, the timetable says so rather than letting you book and cancelling it later.
  • Waitlists. When a class is full you can join the waitlist, if the studio has waitlists switched on and the list is not itself full. Nothing is charged while you wait. The moment a place frees up, the first person on the list is moved into it automatically and emailed — and it is at that point, not before, that a credit is spent or your membership is used.
  • Duo Private. A Duo Private is priced per person and needs a nominated partner at the time of booking.

Cancelling, late cancels and no-shows

You can cancel from your account, on the booking itself. What happens next depends on how far ahead of the class you do it.

  • Inside the free-cancellation window — the window shown on your booking and in your account, which the studio sets and can change — the booking is cancelled and the class credit goes straight back to your wallet. If a membership covered the seat, nothing was spent and nothing needs returning.
  • After that window the cancellation still goes through, but it is recorded as a late cancel and the credit is forfeited. Cancelling once the class has started is always a late cancel.
  • Not turning up is recorded as a no-show. The seat was held for you, so it is treated the same way as a late cancel: the credit is spent and does not come back.
  • On an unlimited membership a late cancel or a no-show is still recorded against you, but your membership covered the seat, so there is no credit to lose.
  • Leaving a waitlist costs nothing at any time — you were never charged for a place you did not have.

Repeated late cancels and no-shows are a problem for the members who could not get into those classes, and we may restrict booking for an account that does it habitually.

Classes we cancel or cannot run

Sometimes we are the ones who cannot run a class — an instructor is ill, equipment fails, a typhoon closes the mall, a public advisory keeps everyone home.

  • If we cancel a session, you are made whole: the credit is returned in full, whatever notice we were able to give. If a membership covered the seat, nothing was spent and nothing is returned.
  • Under-filled classes. Some class types need a minimum number of people to run at all. If one of those is still short of its minimum inside the notice window before it starts, we will contact you and offer the choice: release the place and take the credit back, or pay the difference in credits and run it with the smaller group.
  • We may change a timetable, a class level, an instructor or a studio’s opening hours. Where a change materially affects a class you have already booked, we will tell you and you may cancel that booking without penalty.

Class credits and packages

Packages are not subscriptions. Buying one puts a number of class credits into your account, each with an expiry date, and booking a class spends one of them.

  • Credits expire. Every package carries a validity period set at the point of sale, and every credit it grants carries the expiry date that follows from it. The date is shown against your balance in your account before you buy and every day after.
  • A credit has to be valid on the day the class runs, not merely on the day you book it.
  • Expired credits are gone. They are not refunded, extended or converted into anything else as of right. If something happened — illness, injury, a family emergency — write to us before they lapse and we will do what we reasonably can.
  • Some credits are restricted to particular class types or coach levels. Where they are, the restriction is shown on the credit. When more than one credit could pay for a class, we spend the most restricted one first, then the one closest to expiring, so the least possible value is lost.
  • Credits and packages are personal to you and cannot be transferred or resold.
  • Credits bought at one studio are valid at either studio.

Memberships

A membership bills on a recurring cycle and either covers your classes outright or drops a set number of credits into your account each cycle. The plan, the price, the cycle dates and what it covers are on your membership page.

  • Billing. Each cycle is charged in advance, on the renewal date shown in your account. We send a reminder before it.
  • Upgrading takes effect immediately. You pay the difference between the two plans for the days left in the current cycle, and any extra credits the higher plan grants land at once.
  • Downgrading takes effect at your next renewal, not before, and there is no refund of the difference for the cycle you have already paid for. Until then you keep the plan you are on.
  • Pausing. A membership can be frozen for up to one month, and a freeze can only be started once in a set cooling-off period. The dates you are allowed to choose are shown on the freeze form. Classes cannot be booked on a frozen membership.
  • Cancelling. You can cancel from your account at any time. Cancellation takes effect at the end of the cycle you have already paid for — you keep what you have paid for, and you are not billed again.
  • Credits granted by a membership belong to the cycle that granted them and expire with it unless the plan says otherwise.

Prices, promotions and their conditions

Prices are in Philippine pesos and are the same at both studios. The rate card on the site is the current one; we may change prices, and a change never affects a package or a membership cycle you have already paid for.

Promotions carry their own published conditions, and those conditions are part of the offer rather than small print we can move afterwards. Two examples of the form they take, as published today:

  • On package blocks — “Valid two months from purchase, limited to the first 20 buyers. A further 3% comes off for cash payments and bank transfers. PWD/SC discounts are not applicable.”
  • On the introductory class — “Fridays only, first-time clients, subject to availability. Valid one month.”

Read the conditions printed beside whichever offer you are actually buying: they are what binds, not the two quoted above, and they change from promotion to promotion. Where a discount for persons with disability or senior citizens is excluded from a promotional block, that exclusion applies to the discounted block only — your statutory entitlement to the mandated discount on the standard, undiscounted price is unaffected, and reception will apply it against your ID.

Paying, and your receipt

Payment is due in advance, online or at the studio. Online payments run through Xendit, a licensed Philippine payment gateway, on a hosted checkout page Xendit controls. One invoice covers card, GCash, Maya, QR Ph, bank transfer and over-the-counter payment. A hosted invoice is open for a limited period and then expires; if yours does, start again from your account.

We never see or store your card details.They are entered on Xendit’s own page and held by Xendit. What comes back to us is the result of the payment, the method used and the reference — never the card number.

Every settled payment gets a numbered receipt, recorded against your account and emailed to you. You can see and re-open all of them under My account → Payments.

Refunds

Packages, class credits and memberships are sold as non-refundable, non-transferable and non-exchangeable. That is the studio’s standing position and it is what you agree to at the point of sale. Being straight about it matters more than a paragraph of hedging: you should buy a block expecting to use it.

What that means in practice, and what happens when we do agree to refund:

  • A full refund of a purchase closes off whatever it bought that you have not yet used. Anything already spent — classes you attended, credits already burned — stays spent and is not clawed back.
  • A partial refund changes nothing about what you are entitled to. You keep the credits and the membership.
  • A refund does not, by itself, cancel a membership or a booking. Those are separate acts and we will confirm them separately.
  • Money goes back the way it came, through Xendit to the account or card that paid. Timing is the bank’s, not ours.

None of the above takes away your rights under Philippine law. The Consumer Act of the Philippines (Republic Act No. 7394) gives you rights against defective or misrepresented services that cannot be signed away, and nothing in these terms is intended to limit them. If we do not deliver what you paid for, you are entitled to a remedy regardless of what this section says, and you may take the matter to the Department of Trade and Industry.

Points, rewards and referrals

Where the studio is running its points programme, classes and purchases earn points, and points are redeemed against rewards and free classes claimed at the studio. Where the studio is running referrals, you get a personal code to share and a reward when it is used.

  • Points and referral rewards have no cash value, cannot be sold or transferred, and are not property.
  • The earn rates, the value of a point and any expiry are studio settings, shown to you in your account as they stand. We may change them going forward.
  • We may withhold or reverse points obtained through duplicate accounts, self-referral or anything else designed to game the programme.
  • You can leave the points programme from your account. Points already earned stay on your account.
  • We may end either programme, with notice, without that affecting anything you have already paid for.

The members' video library

Where the studio makes its members’ video library available, an active membership or unused class credits unlock it. While your access lasts, we grant you a personal, revocable, non-exclusive, non-transferable licence to stream the videos for your own training. That is all it is.

  • No downloading, recording, screen-capturing, re-streaming, publishing or sharing — with a friend, in a group chat, or anywhere else.
  • No commercial use of any kind, including teaching from the material.
  • No sharing your login. Access is per member, not per household.
  • Access ends when your membership ends or your credits run out, and we may remove or replace any video at any time.

The videos follow the same rule as every class: they are general instruction, not a clinical programme. If something hurts, stop, and speak to a coach or your doctor.

Studio rules, health and the waiver

The studio rules exist for the room to work and for people not to get hurt.

  • Arrive about ten minutes early to check in. Arrive late and your session may be shortened, for your own safety and the group’s.
  • Wear fitted clothing. Grip socks are required, and shoes come off in the workout area.
  • Follow your instructor’s cueing and the equipment settings you are given. Do not adjust springs or apparatus you have not been shown.
  • Treat coaches, staff and other members decently. We will ask anyone who does not to leave.

Health, and telling us about it

Before your first session you complete the studio’s Liability Waiver & Consent Form. It asks five health questions — injuries and medical conditions, spinal conditions, ongoing therapy, pregnancy, and recent birth — and you agree to the waiver terms set out on it.

You must answer honestly, keep the answers current in your account when something changes, and tell your instructor about any condition or injury beforethe session begins. If you answer yes to any of the health questions, the studio requires a doctor’s consent before you take part — as the form puts it: “Without this consent, you may not be allowed to join the session for your safety and well-being.” We may also recommend that you start in a private session rather than a group class. That is a recommendation, not a bar.

Your health answers are sensitive personal information and are handled as described in the Privacy Policy. Only teaching staff see them.

Photography and video consent is separate from the waiver, is opt-in, and you can withdraw it at any time from My account → Profile.

Risk, and the limits of our liability

Pilates is strenuous physical activity and carries inherent risks, including muscle strains and sprains and, rarely, more serious injury. You take part voluntarily and accept those risks. Nothing we teach is medical advice, diagnosis or treatment, and no outcome is promised.

To the fullest extent Philippine law allows, we are not liable for indirect or consequential loss, for loss of profit or opportunity, for injury or loss caused by your own failure to disclose a health condition or to follow instruction, for property you bring into the studio, or for interruptions to this website. Where we are liable for anything arising out of these terms, our total liability is limited to the amount you paid us for the class, package or membership cycle the claim relates to.

The limits above do not apply, and are not intended to apply, to anything that cannot lawfully be excluded or limited. That includes death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, gross negligence or wilful misconduct, and your rights under the Consumer Act of the Philippines. If any part of this section is found unenforceable, the rest stands.

Using this website properly

Use the website and your account for what they are for. Do not:

  • try to get into another member’s account, or into any part of the system you have not been given;
  • scrape, crawl or bulk-download the site, or hammer it with automated requests;
  • probe, disrupt or work around any security or rate limit;
  • upload anything unlawful, defamatory or malicious, including to your profile photo;
  • make bookings you do not intend to attend, or hold places for people who are not you;
  • copy the site’s design, copy or photography for another business.

If you find a security problem, tell us at contact@theelitepilatesclub.com before you tell anyone else. We will thank you properly.

Intellectual property

The Elite Pilates Club name and marks, the site’s design and copy, the photography, the class programming and every video in the members’ library belong to us or to our licensors and are protected under the Intellectual Property Code of the Philippines (Republic Act No. 8293). Nothing in these terms transfers any of it to you.

Anything you send us — a review, a suggestion, a photograph you give us permission to use — you allow us to use for running and promoting the studio. You keep ownership of it, and you can withdraw photography consent at any time from your account.

Suspension and termination

We can suspend or close an account that breaks these terms or the studio rules, that repeatedly fails to turn up for booked classes, that has an unpaid balance, or where keeping it open would put staff or other members at risk. Where the circumstances allow, we will tell you first and give you a chance to put it right.

If we close your account for a reason that is not your fault, we refund unused credits and the unused part of the current membership cycle. If we close it because of a serious breach — as the studio’s own rules put it, dismissal from the studio without a refund — unused credits may be forfeited, subject always to your rights under the Consumer Act.

You can close your own account at any time. Ask us, and see the Privacy Policy for what is erased and what we are required to keep.

Changes to these terms

We may change these terms — because the law changes, or because the studio does. The current version is always here, with the date it took effect at the top of the page.

For a change that materially affects you, we will give reasonable notice by email to the address on your account or by a notice on the site before it takes effect. Carrying on using your account after that is acceptance. If you would rather not accept it, tell us and stop booking; anything you have already paid for continues under the terms you bought it on.

Governing law and venue

These terms are governed by the laws of the Republic of the Philippines. Any dispute arising out of them is subject to the exclusive jurisdiction of the proper courts of the Philippines — and, where a venue must be named, the courts with jurisdiction over the studio’s registered office, which is To be confirmed.

Before anyone goes to court, write to us. Most of what ends up as a dispute is a booking record two people are reading differently, and we would rather look at it than litigate it.
